BlueTidy Terms & Conditions

⚠️ Important Legal Notice: BlueTidy is a marketplace platform that connects Hosts with Cleaners. We do not employ Cleaners or own the properties listed. Your use of this platform is at your own risk.
1. Acceptance of Terms
By accessing or using BlueTidy ("Platform", "we", "us", "our"), you agree to these Terms. If you disagree, do not use our Platform.
2. Definitions
- "Host" - Property owner/manager listing properties for cleaning
- "Cleaner" - Individual or business providing cleaning services
- "Platform" - Website and mobile application operated by BlueTidy
- "Verification" - Email and identity verification process
3. Platform Role & Limitations of Liability
🔴 CRITICAL LIABILITY DISCLAIMER:
BlueTidy is a TECHNOLOGY PLATFORM that facilitates connections between Hosts and Cleaners. We do NOT:
- Employ, supervise, or control Cleaners
- Inspect properties before or after cleaning
- Guarantee the quality, safety, or legality of services
- Assume responsibility for on-site incidents
3.1 For Hosts
YOU UNDERSTAND AND AGREE THAT:
- BlueTidy is NOT responsible for property damage, theft, or loss caused by Cleaners
- You are SOLELY responsible for screening Cleaners beyond our basic verification
- You should maintain your own property insurance
- Even verified Cleaners can cause damage - we cannot prevent this
- We recommend requiring Cleaners to provide proof of their own liability insurance
- By using ANY Cleaner (verified or not), you assume all risk of property damage
3.2 For Cleaners
YOU UNDERSTAND AND AGREE THAT:
- BlueTidy is NOT responsible for injuries, accidents, or incidents at Host properties
- You must maintain your own liability insurance
- You are responsible for your own safety and equipment
- Hosts may have hazardous conditions - inspect before working
3.3 What We ACTUALLY Do
- ✅ Verify email addresses
- ✅ Collect and hold payments securely via Stripe
- ✅ Provide dispute resolution assistance
- ✅ Remove users with repeated complaints
- ❌ Cannot prevent on-site incidents
- ❌ Cannot guarantee cleaner honesty or quality
4. Payment & Escrow
4.1 How Payments Work
- Hosts pay when booking - funds held by Stripe (not BlueTidy)
- Funds released to Cleaner AFTER Host approval or 48-hour auto-approval
- Stripe is the payment processor - we don't touch your money directly
- Disputes may result in funds being held until resolution
4.2 Payment Disputes
- If Host claims damage, funds may be frozen
- Both parties must provide evidence
- We may release payment if no proof of damage
- We may withhold payment if damage is proven
- Maximum liability limited to service fee amount
5. Verification
5.1 Email Verification
- All users must verify email address
- Unverified users have limited platform access
5.2 Cleaner Identity Verification
- Cleaners may complete Stripe identity verification (optional but recommended)
- Verification fee is non-refundable
- Verification does NOT guarantee trustworthiness or quality
- Verified status only confirms identity, not character
⚠️ VERIFIED DOES NOT MEAN TRUSTWORTHY:
Identity verification only proves someone is who they claim to be. It does NOT guarantee they are honest, skilled, or won't cause damage. Always use your judgment.
6. Host Responsibilities
- Provide accurate property descriptions
- Disclose all hazards (pets, stairs, chemicals, etc.)
- Maintain property insurance
- Secure valuables before cleaner arrives
- Document property condition before and after cleaning
- Pay agreed amounts promptly
- Provide honest reviews
7. Cleaner Responsibilities
- Perform services professionally and safely
- Maintain liability insurance (recommended: $1,000,000 minimum)
- Report damages immediately
- Communicate delays or issues
- Respect property and privacy
- Complete all agreed tasks
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BlueTidy's TOTAL liability is limited to the fees paid in the preceding 12 months
- We are NOT liable for property damage, injury, theft, or any on-site incidents
- We are NOT liable for indirect, consequential, or punitive damages
- We are NOT responsible for user conduct, even if "verified"
- You assume all risks of using the Platform
9. Indemnification
You agree to indemnify and hold BlueTidy harmless from any claims arising from:
- Property damage caused by Cleaners you hire
- Injuries occurring at properties
- Disputes between users
- Your violation of any law
10. Insurance Requirements
For Cleaners (Strongly Recommended):
- General liability insurance ($1,000,000 minimum)
- Workers' compensation (if applicable)
- Equipment insurance
For Hosts (Strongly Recommended):
- Property insurance covering cleaners
- Liability insurance
- Theft coverage
11. Dispute Resolution
- Step 1: Contact support@bluetidy.com for assistance
- Step 2: We facilitate communication between parties
- Step 3: If unresolved, binding arbitration (see Section 12)
12. Arbitration Agreement
- All disputes resolved through binding arbitration
- Class action waiver applies
- Small claims court option available for disputes under $5,000
- Arbitration administered by [Your Arbitration Association]
13. Governing Law
These Terms are governed by the laws of [Your State], without regard to conflict of laws principles.
14. Termination
We may suspend or terminate accounts for:
- Terms violation
- Fraud or illegal activity
- Multiple complaints about damage or conduct
- Non-payment of fees
15. Changes to Terms
We may update these Terms. Material changes notified via email or platform notification. Continued use constitutes acceptance.
